Utah Code Title 17 Chapter 27a Section 802

Enforcement.

(1)

(a) A county or any adversely affected owner of real estate within the county in which violations of this chapter or ordinances enacted under the authority of this chapter occur or are about to occur may, in addition to other remedies provided by law, institute:

(i) injunctions, mandamus, abatement, or any other appropriate actions; or

(ii) proceedings to prevent, enjoin, abate, or remove the unlawful building, use, or act.

(b) A county need only establish the violation to obtain the injunction.

(2)

(a) The county may enforce the ordinance by withholding building permits.

(b) It is unlawful to erect, construct, reconstruct, alter, or change the use of any building or other structure within a county without approval of a building permit.

(c) The county may not issue a building permit unless the plans of and for the proposed erection, construction, reconstruction, alteration, or use fully conform to all regulations then in effect.

Title 7 - Buildings and Construction

7-1D-1: Permits Required:

Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this title, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. (1998 Code § 15.05.010)

Violation

Violation of the requirement to obtain a building permit is a Class B Misdemeanor. Class B Misdemeanors can be prosecuted in the court with each day that the violation exists being treated as a separate offence. The maximum fine for a Class B Misdemeanor is $1,000.00 (UCA. 76-3-301(d)) or 6 months in jail (UCA 76-3-204(2)) or both.

Building codes are adopted for the purpose of establishing minimum requirements to safeguard the public health, safety and general welfare through structural strength, means of egress facilities, stability, sanitation, adequate light and ventilation, energy conservation, and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to fire fighters and emergency responders during emergency operations.

Permits are required so the jurisdiction can perform inspections to verify the adopted codes are followed.
